Classifieds Rules - WE EXPECT YOU READ THIS BEFORE LISTING

Postby nodakoutdoors.com » Thu Nov 08, 2007 4:46 pm

Nodak Outdoors rules for the classifieds.

We insist that you read all rules before you post an ad or commence in any transaction.

Ads are totally free to individual registered members.

Buyer/seller beware. Meaning if you do not know who you are buying/trading/selling with, make sure you take appropriate safeguards to protect yourself like getting full name, complete address, phone number, etc… If you send payment via the USPS, it is a federal felony not to honor the transaction once you cash a check or M.O. Make sure you follow up on all transactions like acknowledging you received payment, the goods, etc. Send goods with a “confirmed receipt” that the buyer received it.

Ads must state in the title whether it is “for sale”, “wanted”, or “for trade”. And must clearly state in the ad title what is being listed. For example: “Remington 1187 shotgun for sale” or “Foiles SMH goose call for trade” or “Wanted – Finished Labrador Retriever Dog."

For sale items must clearly state the asking price. No best offers or auctions or similar are allowed. This includes no links or posts about auctions. And yes, NO LINKS TO EBAY LISTINGS.

No Business ads are allowed. This includes dog kennels. If you make, assemble parts, mark up the price, etc. for sale/resale—that is a business under our definition. If you are a business, please become a sponsor to advertise your product or services. Please contact [email protected] to become a sponsor. Sponsors may include a link on their signature and posts to their business website and may sell items/services on the classifieds. NonSponsors may not.

Firearms. You must abide by all federal, state and local laws and regulations. You may only ship guns to a FFL holder per Fed law.

About dogs/puppies. You may post an ad for 1 dog or 1 litter per calendar year as long as you are an individual not running a kennel. A definition of a kennel that we use is if you are selling more than 1 dog per year or having more than 1 litter per year or receiving stud fee/s. Kennels are not allowed to list their litters/dogs in the classifieds, but may become a sponsor at this site to advertise their Kennel.

Land/leases. No land for sale, leases, etc. are allowed.

By listing an ad or responding to an ad you agree to hold Nodak Outdoors LLP(Nodak Outdoors), its owners, employees and moderators (know hence forth as “WE”) harmless in all transactions and are agreeing to abide by all the rules set forth by Nodak Outdoors. By posting or reading an ad, you are agreeing that WE will NOT be held responsible for the content of any message, the selling, buying, or trading of any item, product, or service. You also agree that in no way will WE be held liable for any transaction at the Nodak Outdoors Classifieds, including but not limited to injury and/or death. By creating a post, or making a transaction, you are agreeing to these terms. We reserve the right to ban a member, edit or delete any post for any reason.

I can't vouch for the legalities....I was always under the assumption you need a license to sell, even just your personal overstock.

I've been told that guns may be shipped to an individual within the same state.

Any clarification?

Im sure you will need a federal Firearms license if you plan to sell shells in the bulk.

Selling ammo

Postby Gav-n-Tn » Tue May 19, 2009 1:40 am

I'll help y'all out a little. Here's what the Federal law says:

(A4) What kinds of ammunition are covered by the GCA?

Ammunition includes cartridge cases, primers, bullets or propellant powder designed for use in any firearm other than an antique firearm.

Items NOT covered include blank ammunition, tear gas ammunition, pellets and nonmetallic shotgun hulls without primers.

Generally, no records are required for ammunition transactions. However, information about the disposition of armor piercing ammunition is required to be entered into a record by importers, manufacturers, and collectors.

A license is not required for dealers in ammunition only.

[18 U.S.C. 921(a)(17) and 922(b)(5), 27 CFR 478.11 and 478.125]

Now for my 2 cents:
There is, however, an age requirement for purchasing ammunition. You need to make sure that you are selling to someone that is at least 21 years of age. A copy of a driver's license with a signed statement verifying: #1. Age and #2. That the individual is not restricted from purchasing ammo
is standard operating procedure.
It is also very wise to make sure that there aren't any local laws preventing the sale to the individual especially if you are shipping it. Most of those local laws will apply to ammo above a certain caliber.

It is perfectly legal to transfer long guns to another person without FFL per state rules. I would make sure you document purchase/sale to other person though. I sell guns for a living.

A person does not need anything special to sell ammunition. The usps doesn't allow shipping of ammunition so it would have to ship UPS or Fed-Ex. You must also attach a 'ORM-D' label to the outside of the box. A quick google search should turn up some places to print off a ORM-D label.

Summary of Ammunition...

You do not need a FFL to sell ammunition.

You need an 03FFL to manufacture ammunition for resale - also manufacturers may be subject to registering with the U.S. State Department and pay a fee for ITAR (International Traffic in Arms Regulations). I agree its stupid, but the state department has recognized ammunition, even hunting loads, as destructive devices. The good part is that the ATF does not really care what the state department does and does not enforce ITAR. So, basically if you choose to make and sell your own ammunition... see below

If you are selling reloaded ammunition, without a 03 FFL, and lots of liability insurance, I pity you if something goes wrong.

You may sell factory ammunition that you have purchased to another individual.
